PRIVACY POLICY

DEFINITION OF TERMS

The following terms are used in this Privacy Policy:

• «Site» refers to www.en.dat-studio.com
• «Site Administration» refers to the authorized staff managing the site, acting on behalf of the Limited Liability Partnership «DaT Studio», who organize and/or carry out the processing of personal data, as well as determine the purposes of personal data processing, the composition of personal data to be processed, and the actions (operations) performed with personal data.
• «Personal data» means any information related directly or indirectly to a specific or identifiable individual (personal data subject).
• «Processing of personal data» means any action (operation) or a set of actions (operations) performed with or without the use of automation tools on personal data, including collection, recording, systematization, accumulation, storage, refinement (updating, modification), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data.
• «Confidentiality of personal data» is a mandatory requirement for the Site Administration or other person who has gained access to personal data to prevent their dissemination without the consent of the personal data subject or the presence of another legal basis.
• «Site User (hereinafter User)» refers to an individual who has access to the Site via the Internet and uses the Site.
• «Cookies» — a small piece of data sent by a web server and stored on the user's computer, which the web client or web browser sends to the web server in an HTTP request each time it tries to open a page of the corresponding site.
• «IP address» — a unique network address of a node in a computer network built using the IP protocol.

GENERAL PROVISIONS

The use of the Site by the User means acceptance of this Privacy Policy and the terms of processing the User's personal data.

In case of disagreement with the terms of the Privacy Policy, the User must stop using the Site.

This Privacy Policy applies only to the Site. The Site does not control and is not responsible for third-party sites to which the User can click on links available on the Site.

The Site Administration does not verify the accuracy of personal data provided by the Site User.

SUBJECT OF THE PRIVACY POLICY

This Privacy Policy establishes the obligations of the Site Administration for nondisclosure and ensuring the confidentiality of personal data which the User provides at the request of the Site Administration when registering on the Site or performing other actions through the Site.

Personal data allowed for processing under this Privacy Policy is provided by the User by filling out the registration form on the Site or by performing other actions on the Site, and may include the following information:

• the User's surname, first name, patronymic;
• the User's contact phone number;
• email address (e-mail);

The Site protects data that is automatically transmitted when visiting pages on which a statistical script of the system («pixel») is installed:

• IP address;
• information from cookies;
• information about the browser (or other program that provides access to display ads);
• access time;
• the page address where the ad block is located;
• referrer (address of the previous page).

Disabling cookies may result in the inability to access parts of the Site requiring authorization.

The Site collects statistics about the IP addresses of its visitors. This information is used to identify and solve technical problems, to control the legality of financial payments.

Any other personal information not specified above is securely stored and not disclosed, except for the cases provided in clause 5.2. of this Privacy Policy.

PURPOSES OF COLLECTING USER'S PERSONAL INFORMATION

The Site Administration may use the User's personal data for the purposes of:

• Identifying the User registered on the Site.
• Providing the User access to personalized resources of the Site.
• Establishing feedback with the User, including sending notifications, inquiries regarding the use of the Site, provision of services, processing of requests and applications from the User.
• Determining the User's location to ensure security and prevent fraud.
• Confirming the accuracy and completeness of personal data provided by the User.
• Providing the User with effective customer and technical support in case of problems related to the use of the Site.
• Providing the User, with their consent, newsletters and other information on behalf of the Site.
• Conducting advertising activities with the User's consent.
• Providing the User access to the websites or services of the Site's partners to obtain products, updates, and services.

METHODS AND TERMS FOR PROCESSING PERSONAL INFORMATION

The processing of the User's personal data is carried out indefinitely, by any legal means, including in personal data information systems with or without the use of automation tools.

In the event of loss or disclosure of personal data, the Site Administration informs the User about the loss or disclosure of personal data.

The Site Administration takes necessary organizational and technical measures to protect the User's personal information from unauthorized or accidental access, destruction, modification, blocking, copying, distribution, and other unlawful actions of third parties.

The Site Administration, together with the User, takes all necessary measures to prevent losses or other negative consequences caused by the loss or disclosure of the User's personal data.

OBLIGATIONS OF THE PARTIES

The User is required to:

• Provide information about personal data necessary for using the Site.
• Update, supplement the provided information about personal data in case of any changes to this information.

The Site Administration is required to:

• Use the information received exclusively for the purposes specified in clause 4 of this Privacy Policy.
• Ensure confidential information is kept secret, not disclosed without the prior written permission of the User, and also not to sell, exchange, publish, or disclose the transferred personal data of the User in any other possible ways, except as provided in clause 5.2. of this Privacy Policy.
• Take precautionary measures to protect the confidentiality of the User's personal data in accordance with the procedure normally used to protect such information in existing business transactions.
• Block personal data related to the respective User from the moment of contact or request from the User or their legal representative or authorized body for the protection of the rights of personal data subjects for the period of verification, in case of unreliable personal data or illegal actions.

LIABILITY OF PARTIES

The Site Administration, having failed to fulfill its obligations, is liable for the losses incurred by the User due to the unlawful use of personal data, in accordance with the legislation of the Republic of Kazakhstan, except as provided in clauses 5.2. and 7.2. of this Privacy Policy.

In the event of loss or disclosure of Confidential Information, the Site Administration is not liable if such confidential information:

• Became public domain before its loss or disclosure.
• Was received from a third party before it was obtained by the Site Administration.
• Was disclosed with the consent of the User.

DISPUTE RESOLUTION

Before filing a lawsuit in disputes arising from relations between the Site User and the Site Administration, it is mandatory to submit a claim (a written proposal for voluntary dispute resolution).

The claim recipient, within 30 calendar days from the day of receiving the claim, shall notify the claimant in writing of the results of the claim consideration.

If an agreement is not reached, the dispute shall be referred to the judicial authority in accordance with the current legislation of the Republic of Kazakhstan.

The current legislation of the Republic of Kazakhstan applies to this Privacy Policy and the relations between the User and the Site Administration.

ADDITIONAL CONDITIONS

The Site Administration has the right to make changes to this Privacy Policy without the User's consent.

The new Privacy Policy comes into effect from the moment it is posted on the Site unless otherwise provided by the new edition of the Privacy Policy.
